Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Opsenes platform, websites, and related services (collectively, the “Service”) provided by Opsenes (“Opsenes,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

1. Early access

The Service is currently offered on a limited early-access basis. It may contain features that are incomplete, subject to change, or offered for evaluation. We may modify, suspend, or discontinue any part of the Service at any time during the early-access period, and availability or performance is not guaranteed.

2. Accounts

To use the Service you may need to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it up to date.

3. Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer or attempt to extract the source code of the Service, except as permitted by law.
  • Upload content that is unlawful, infringing, or harmful, or that you do not have the right to share.

4. Your content and data

You retain all rights to the data and content you submit to the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide, secure, and improve the Service in accordance with these Terms and our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents to submit Customer Data.

5. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by Opsenes and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as described here.

6. Third-party integrations

The Service may connect to third-party tools and services at your direction. Your use of those integrations is governed by the applicable third party’s terms, and we are not responsible for their availability, security, or practices.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Opsenes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and we may delete Customer Data in accordance with our data-retention practices.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
